Please read the terms and conditions carefully to avoid miscommunication.

1.1 These Terms and Conditions apply to all legal relationships between BreemerVisuals (hereinafter: "the Photographer") and the Client, including quotations, order confirmations, and agreements, unless explicitly agreed otherwise in writing.
1.2 Deviations from these terms are only valid if agreed upon explicitly and in writing.

2.1 All quotations by the Photographer are non-binding unless explicitly stated otherwise.
2.2 An agreement is established when the Client accepts the Photographer's quotation.

3.1 The Photographer's rates are specified in the quotation and exclude additional costs such as travel expenses, studio fees, and extra edits unless agreed otherwise in writing.
3.2 Payment must be made within 14 days of the invoice date unless otherwise agreed in writing.
3.3 If the Client fails to pay on time, statutory interest plus an additional 5% per week will be charged on the outstanding amount from the due date.
3.4 In the event of non-compliance with payment obligations, all (extra)judicial collection costs will be borne by the Client.
3.5 No use of the photographic work is permitted as long as the Client has not fully paid any outstanding invoices.

4.1 In the event of cancellation by the Client, the following fees apply:
Between 7 days and 48 hours before the scheduled date: 50% of the total costs.
Less than 48 hours before the scheduled date: 75% of the total costs.
4.2 Rescheduling is only possible in consultation with the Photographer. Additional costs may be charged.

5.1 The Photographer provides standard edited files in JPEG format. RAW files are not provided unless explicitly agreed upon in writing for an additional fee.
5.2 Failure to deliver on time by the Photographer is not a valid reason for terminating the Agreement.

6.1 The Photographer retains the copyright to all photos taken.
6.2 The client obtains a one-time, non-exclusive right to use the Service, restricted to the specific title for which it was created, unless otherwise specified.
6.3 The client may not transfer the exploitation rights to third parties or grant (sub)licenses, unless otherwise agreed.

7.1 It is not permitted to edit or alter the photos without the Photographer's written permission.
7.2 If edits are desired, they must be performed by the Photographer or a third party with explicit permission from the Photographer.

8.1 The Photographer is not liable for damages occurring during the photoshoot unless caused by gross negligence or intent.
8.2 The Photographer's liability is limited to the amount of the invoice.

9.1 Complaints must be reported in writing within 5 days of receiving the photos.
9.2 If no complaints are reported within this period, the Client is deemed to have fully accepted the work.

10.1 The Photographer is not liable for delays or cancellations caused by force majeure, including illness, pandemics, extreme weather conditions, or other unforeseen circumstances.

11.1 The Photographer reserves the right to use the photos for promotional purposes unless the Client explicitly objects in writing.
11.2 The Client is responsible for obtaining consent from subjects featured in the photos, if applicable.

12.1 Dutch law applies to all legal relationships between the Photographer and the Client.
12.2 Disputes will be submitted to the competent court in the district where the Photographer is located.

13.1 These Terms and Conditions come into effect on 01-01-2025 and replace all prior agreements between the Photographer and the Client.
13.2 By agreeing to a quotation or assignment, the Client confirms having read and agreed to these Terms and Conditions.
